Terms & Conditions

Last Updated: October 2026

Welcome to En Fleurs. By accessing www.enfleurs.ca or placing an order, customers agree to the following Terms & Conditions, subject to applicable consumer protection laws.

Please review these terms carefully before completing a purchase.

1. Products & Availability

En Fleurs specializes in field-grown peony roots cultivated in Quebec, Canada.

All peony roots are living agricultural products, and availability is subject to growing conditions, harvest results, and seasonal factors.

While every effort is made to maintain accurate product descriptions and inventory, unforeseen circumstances may affect the availability of specific varieties.

If a purchased variety becomes unavailable, the customer will be contacted and offered a refund for the unavailable item or an alternative variety, subject to the customer's approval.

Substitutions will not be made without customer consent.

Photographs are provided for identification and illustrative purposes. Bloom colour, size, form, and plant characteristics may vary depending on growing conditions, climate, soil, and plant maturity.

2. Orders & Payment

All orders must be placed through the website unless alternative arrangements have been approved.

Payment is required at the time of purchase unless otherwise specified.

Prices are displayed in the currency indicated at checkout. Applicable taxes, shipping fees, and other disclosed charges are calculated during the ordering process.

An order confirmation will be sent to the email address provided at checkout.

En Fleurs reserves the right to correct pricing or inventory errors. If an error affects a confirmed order, the customer will be contacted to approve any proposed change or receive an appropriate refund.

3. Preorders & Seasonal Sales

Peony roots are sold primarily as seasonal preorders, with delivery scheduled for the fall planting season.

Placing a preorder reserves the selected varieties for the upcoming harvest, subject to crop availability and quality inspection.

Estimated shipping periods are provided for planning purposes and may vary due to weather, harvest conditions, or other circumstances affecting agricultural production.

If an order cannot be fulfilled, the customer will be notified and an appropriate refund or alternative resolution will be offered.

4. Shipping & Delivery

Peony roots are typically harvested and shipped between September and October, depending on growing conditions and destination.

Orders are carefully inspected and packaged before dispatch.

Customers are responsible for providing accurate and complete shipping information, including a valid delivery address, email address, and contact details.

Shipping confirmation and tracking information will be provided when available.

Delivery dates are estimates and may be affected by carrier disruptions, weather conditions, customs processing, or other circumstances beyond reasonable control.

For additional information, please consult the Shipping Information page.

5. United States Shipping & Phytosanitary Requirements

Orders shipped to the United States are subject to applicable agricultural import regulations and customs requirements.

An additional phytosanitary inspection and certification fee applies to U.S. shipments requiring this documentation.

This fee is separate from standard shipping charges and covers the applicable inspection and certification process.

Shipments will only be dispatched when the necessary documentation and import requirements have been satisfied.

Changes to import regulations may affect shipping eligibility, documentation requirements, and associated fees.

6. United States Import Tariffs & Customs Charges

Customers purchasing peony roots for delivery to the United States are responsible for all applicable import tariffs, duties, taxes, and customs-related charges.

To facilitate customs clearance, applicable import tariffs are prepaid by En Fleurs prior to shipment.

Customers will receive a separate invoice for any applicable tariffs before their order is dispatched.

All tariff invoices must be paid in full before shipment.

Tariff rates and import requirements may change between the original purchase date and the scheduled shipping date.

By placing an order for delivery to the United States, customers acknowledge that additional import charges may apply and agree to pay the applicable charges prior to shipment.

7. Unpaid Tariff Invoices

Orders will not be dispatched while required tariff payments remain outstanding.

If a customer refuses or fails to pay an applicable tariff invoice, the order may be cancelled.

Orders cancelled due to refusal or non-payment of required import tariffs are non-refundable, except where a refund is required by applicable law.

Customers are encouraged to consider potential import costs before placing an order.

7. Order Cancellations & Modifications

As peony roots are seasonal agricultural products sold in limited quantities, order changes and cancellations are subject to availability, order status, and applicable consumer protection requirements.

Requests to modify an order should be submitted as early as possible.

Once an order has been harvested, prepared, or dispatched, modifications may no longer be possible.

Cancellation requests will be reviewed individually. Any applicable refund or cancellation charge will be determined in accordance with the terms disclosed at purchase and applicable law.

En Fleurs reserves the right to cancel an order when fulfillment becomes impossible due to crop failure, regulatory restrictions, or other circumstances beyond reasonable control. In such cases, customers will receive any refund required by applicable law.

8. Root Quality & Guarantee

Every effort is made to supply healthy, properly identified peony roots suitable for planting.

Roots are inspected before shipment to ensure they meet established quality standards.

As peonies are living plants, their subsequent growth and performance depend on environmental conditions, planting practices, soil preparation, drainage, climate, and ongoing care.

Customers are encouraged to inspect their roots promptly upon delivery and report any concerns as soon as possible.

Claims involving damaged, incorrect, or visibly compromised roots should include:

  • Order number

  • Description of the concern

  • Clear photographs of the roots and packaging, where applicable

All claims will be reviewed in accordance with the Root Guarantee Policy and applicable consumer protection laws.

Nothing in these Terms & Conditions limits or excludes any statutory warranty or consumer right that cannot legally be waived.

9. Planting & Customer Responsibilities

Customers are responsible for selecting peony varieties appropriate for their growing region and providing suitable planting conditions.

Peony roots should be unpacked promptly upon arrival and planted according to recommended growing practices.

Improper planting depth, inadequate drainage, unsuitable storage conditions, extreme weather, and other environmental factors may affect plant establishment and performance.

Detailed planting instructions are available in the Peony Growing Guide.

10. Natural Variations & Plant Performance

Peonies are living plants, and natural variations in root size, eye development, growth rate, flowering characteristics, and establishment are to be expected.

Newly planted peonies may require several growing seasons to reach maturity and produce their characteristic blooms.

Flowering during the first growing season is not guaranteed.

Product photographs and descriptions represent the typical characteristics of established plants and should not be interpreted as a guarantee of immediate flowering or identical performance in every garden.

11. Returns & Exchanges

Due to the perishable nature of bare-root peonies and the potential for damage or deterioration after delivery, returns and exchanges are generally not accepted for change-of-mind purchases, subject to applicable law.

This policy does not restrict customer rights relating to damaged, defective, incorrectly supplied, or otherwise non-conforming products.

Any eligible claim will be reviewed under the Root Guarantee Policy and applicable consumer protection requirements.

12. Website Information & Intellectual Property

All original website content, including photographs, product descriptions, written materials, graphics, and educational resources, is the property of En Fleurs or its respective rights holders unless otherwise indicated.

Every effort is made to ensure the accuracy of information published on the website. Product details, availability, and policies may be updated as necessary.

13. Limitation of Liability

To the extent permitted by applicable law, En Fleurs is not responsible for losses arising solely from circumstances beyond reasonable control, including extreme weather, natural disasters, government import restrictions, or carrier disruptions.

Nothing in these Terms & Conditions excludes or limits liability, warranties, remedies, or other rights that cannot legally be excluded or restricted under applicable consumer protection legislation.

14. Privacy & Personal Information

Personal information collected through the website is used for legitimate business purposes, including processing orders, arranging delivery, communicating with customers, and meeting applicable legal obligations.

Personal information is handled in accordance with the Privacy Policy and applicable privacy legislation.

15. Changes to Terms & Conditions

These Terms & Conditions may be updated periodically to reflect changes in business practices, shipping procedures, regulatory requirements, or applicable legislation.

The version applicable to an order is the version presented or otherwise agreed to at the time of purchase, except where changes are required by law or subsequently accepted by the customer.

16. Governing Law

These Terms & Conditions are governed by the applicable laws of Quebec and Canada, subject to any mandatory consumer protection laws or jurisdictional rights that apply to customers in other provinces, territories, or countries.

Nothing in these terms prevents customers from exercising rights or remedies available under applicable law.
